Pos 2020 obligation: here we are. From 30st July, professionals and businesses are entitled to a tax credit equal to 2020% of expenses related to the use of the Pos. Based on the 157 Tax Decree (law 2019/XNUMX), to encourage the use of electronic money – traceable tool and, therefore, anti-evasion - the State reimburses a third of bank commissions and fixed costs incurred by those who accept debit and credit cards.

1) POS 2020 OBLIGATION: FOR THE BONUS, TURNOVER CAP AND FEES

However, not everyone is entitled to the bonus. To be included in the group of beneficiaries, it is necessary to have achieved revenues or fees of less than 2019 thousand euros in 400. On the other hand, the accounting system or the legal type used to carry out the activity do not count. The subsidized amounts do not contribute to the formation of income for income tax and IRAP purposes.

2) IT IS USED ONLY IN COMPENSATION

The tax credit can only be used in compensation and starting from the month following the one in which the expenses were incurred. The bonus will have to be included in the 2021 tax return (referring to the 2020 tax year) and in subsequent ones in the event of residual amounts not yet offset due to lack of tax capacity.

3) ONLINE REQUEST TO THE REVENUE AGENCY

To apply for credit, you must use Revenue Agency software: in the communication - to be sent by the 20th of the month following that of the expenses - both the number of operations and the amounts of commissions and fixed costs must be entered. It is established by provision of last April 29 with which the tax authorities gave the green light to the bonus.

4) POS 2020 OBLIGATION: SANCTIONS FOR THOSE WHO SGARRA

What has been said so far can suggest that professionals and businesses can continue to choose whether or not to accept payments with the Pos. In reality, this has not been the case for years now, only that there have been no punishments for transgressors so far. From 30 July, however, those who do not accept an electronic payment risk a fine of 4 euros plus XNUMX% of the value of the refused transaction. The application of sanctions, however, remains cumbersome to say the least, because the consumer's complaint must arrive first and then the assessment by the competent bodies, which send the documents to the Prefect.

5) THE THRESHOLD FOR CASH PAYMENTS DROP

Together with the tax credit on the Pos, the first will also start from July XNUMXst reduction of the limit on cash payments, which drops from 3 to 2 euros.
