Green light of cabinet to the points-based license for safety at work. The rule, contained within the legislative decree on the Pnrr, introduces a new classification system for companies and self-employed workers and from 1 October 2024, it will be mandatory for anyone who wants to operate "in temporary or mobile construction sites”. The purpose? Reduce the very high number of accidents and deaths at work and avoid a repeat of what happened last February 16th on the Esselunga construction site in Florence. But how does this license work? How do you get and lose points? Here's everything you need to know. 

Points-based license for safety at work: how to obtain it

Starting from October 1, 2024, businesses and self-employed workers operating in building sector they will be required to have a digital driving licence. The labor inspectorate will issue it to all individuals in possession of the required requirements

  • registration at the Chamber of Commerce
  • fulfillment of training obligations by the company and workers
  • possession of a valid Durc (Single contribution regularity document).
  • possession of the DVR (Single Tax Regularity Document).

Points-based license for workplace safety: how it works

The license is issued with a initial allocation of 30 points. The operating mechanism is similar to that of the driving license: if you commit an offense or an irregularity you lose points, how many depends on the seriousness. The minor violations are punished with a 5 point deduction for offenses they cause temporary disability 10 will be removed. With permanent, absolute or partial disability 15 points are lost and in this case the Inspectorate can suspend the license for up to 12 months. There death at work will cause the loss of 20 points and, de facto, the company will no longer be able to operate given that, based on what is foreseen, if there are less than 15 points you will no longer be able to work except for the completion of the activities "subject to contract and subcontract in progress at the time of the last reduction".

The deducted credits can however be reinstated following the "frequency of training courses". With each course, 5 credits are recovered, but the credits reacquired cannot exceed 15. Another 10 credits can be triggered automatically two years after the sanction, one per year up to a maximum of 10.

Companies that continue to work even with a license that has fewer than 15 credits are punishable with one fine from 6.000 to 12.000 euros. The task of establishing the sanctions will fall to the National Labor Inspectorate, which in some cases may also suspend your license as a precaution up to a maximum of twelve months.

More inspectors and more checks

A new competition will soon be announced to hire on a permanent basis 250 new technical inspectors. The aim is to strengthen the control system. Not only that, from 1 October 2024, the contingent ofthe carabinieri weapon has increased by 50 units: 25 in the role of inspectors and 25 in the role of officers and carabinieri. The organic resources of INPS and INAIL have also increased.

Illicit administration

The Government has decided to abolish the provision of the Jobs Act which in 2015 had replaced the crime with a fine of 20 euros per day for each worker employed illegally. Now this case becomes a crime again.
