Ottaviano Del Turco has the right to collect the annuity as a parliamentarian. In fact, the Litigation Commission of the Senate unanimously ordered it, accepting the appeal presented against the suspension by the former president of the Lombardy Region Roberto Formigoni. As a result, the other former MPs concerned also regained their pension rights, which had ceased following a controversial 2019 law according to which citizens (and therefore also MPs) should be suspended from paying social security benefits if convicted in definitively, but only if made fugitives or escaped (apart from cases of mafia or terrorist crimes). This was not the case for Del Turco, a former senator and former president of the Abruzzo Region, who has also been afflicted for some time with serious health problems and needs treatment and health care.

“The decision is valid erga omnes. Now the Bureau of the Senate - explains Maurizio Paniz, lawyer of the former governor of Abruzzo - should take note of the decision of the Litigation Commission and order the continuation of the payment of the annuity to former Senator Del Turcootherwise, the commission itself will order it, since the relative appeal has already been presented". While the 5 Star Movement rises up in controversy, it instead welcomes the decision by a large part of the political world, which had spent recent months plead the case by Del Turco.
