Retirees: stop to positions in the PA

The new prohibition, contained in a circular from Minister Madia, concerns both public and private pensioners and also affects the positions conferred by ministers, but has been effective since 25 June 2014 – Some roles have been saved.

Who is already retired it cannot cover important public positions. This is foreseen in a circular signed last December 4 by the Minister of Public Administration, Marianna Sideboard, registered by the Court of Auditors on 20 January and published in the Official Gazette on Saturday 14 February. 

The new ban concerns both public and private pensioners and also affects the positions conferred by ministers, but effective from 25 June 2014, the day on which the Madia decree that sets the new stakes came into force. All retirees who obtained prestigious positions in the public administration before that date will therefore remain in their place.

Furthermore, for the time being, account must be taken of the freeze on hiring up to 2016 established by the Stability law to relocate any redundancies produced by the overrun of the Provinces. The new rules, in any case, could affect the turnover of some heads of the PA.

The objective of the provision is "to prevent the conferment of certain types of assignment from being used by public administrations to continue to make use of retired employees - reads the circular - or, in any case, to attribute to retired subjects significant responsibilities in the administrations themselves, effectively circumventing the very institution of retirement and preventing top positions from being occupied by younger employees. The new provisions express a legislative policy direction aimed at facilitate staff turnover and rejuvenation in public administrations".

Among the activities that retirees will be able to continue to carry out for the PA are the free collaborations for a year, the teaching, the assignments in the competition commissions or in the scientific committees and the role of Special Commissioner "for the temporary administration of public bodies or for the performance of specific tasks".

The circular then recommends that the administrations avoid "elusive behaviour, consisting in conferring tasks and positions on subjects close to retirement whose mandate essentially takes place in a phase subsequent to retirement".
