Subsidized part-time for the over 60s: here is the decree

Labor Minister Poletti signed the decree which should facilitate the turnover between the elderly and young people. It will be possible to agree with the employer on the transition to part-time with a reduction in working hours between 40 and 60%, receiving a tax-free sum every month in the pay slip (in addition to the part-time salary). instead, it will remain unchanged at 100% of the social security check.

The subsidized part-time has officially arrived. The workers of the private sector with permanent contract and full time that they own the minimum contribution requirement for the old-age pension (20 years of contributions) and that the personal data requirement matures by 31 December 2018 may agree with the employer transition to part-time and with a reduction of hours between 40 and 60%, receiving each month in a paycheck (in addition to the salary for the part-time job itself) a tax-free sum equal to the employer's social security contributions on the wages for the unworked hours. This is provided for by the decree signed by the Minister of Labor Giuliano Poletti which regulates the procedures for recognizing subsidized part-time work, introduced by the 2016 Stability Law. In practice, assuming that a worker opts for a 50% reduction in working hours, he will maintain – thanks to the new mechanism – a salary equivalent to approximately 65% ​​of what he received before. When he retires, the same worker will still get 100% of the social security allowance.

For the period of reduction of work performance, the State recognizes the worker the notional contribution corresponding to the service not performed, so that when the worker reaches retirement age he will receive the full amount of the pensionwithout any penalty. The decree was sent yesterday to the Court of Auditors and will become operational after registration.

To access the benefit, the worker must ask INPS for certification which certifies the possession of the contribution requirement and the accrual of the personal one by 31 December 2018. Therefore, the worker and the employer enter into a "subsidized part-time employment contract" which indicates the extent of the reduction in working hours.

La duration of the contract it is equal to the period between the date of access to the benefit and the date on which the worker reaches the age for entitlement to an old-age pension. After the signing of the contract, the decree provides for the release, in five days, of the no impediment document by the Territorial Directorate of Labor and the release of the final INPS authorization in five days.

La figurative contribution, commensurate with the remuneration corresponding to the work not performed, is recognized within the maximum limit of 60 million for 2016, 120 million for 2017 and 60 million for 2018. The decree clarifies that the sum paid monthly by the employer is all-inclusive, it does not contribute to the formation of income from employment and is not subject to any form of social security contribution, including that relating to insurance against accidents at work and occupational diseases.
