Mediaset oversight: the .com domain has expired, the judge rejects the reassignment

The Cologno Monzese company forgot to renew its domain, which was thus purchased, at auction, by the American citizen Didier Madiba of Fenicius Llc - Mediaset's appeal rejected - Madiba's defense: the words "media" and “set”, being very commonly used on the web, are not subject to trademark rights.

Incredible oversight at Mediaset. The Cologno Monzese company in fact, she forgot to renew her .com internet domain, which thus became the property of an American.

After the grace period expired, a company that sells domains at auction bought it for poi resell it to Mr. Didier Madiba of Fenicius Llc, a resident of Delaware.

Ascertained the forgetfulness and the now irreparable damage, Mediaset immediately activated the legal procedures to regain possession of the domain, starting the reassignment procedure at the Wipo (Arbitration and Mediation Center). According to the Berlusconi family company, Didier Madiba bought the mediaset.com domain in bad faith and in violation of the rights that the company itself boasts over the brand.

However, the defense of Madiba himself is impeccable: the words “media” and “set”, being very commonly used on the web, are not subject to trademark rights. And in fact the judge agreed with him, rejecting the practice of reassignment of Mediaset.

The www.mediaset.com domain, for now, therefore remains in the hands of Didier Madiba. At least until an economic proposal arrives which the US will probably no longer be able to resist.
