Guarantee bodies, the fourteenth arrives: the guarantor of human rights

Towards a new guarantee body, the fourteenth in Italy: the guarantor of human rights, "extension" of the activity of the Authority for the protection of personal data. The Constitutional Affairs commission of the Senate will in fact start the discussion on Tuesday 10 January, in the drafting session, of the bill which identifies in the Guarantor for the protection of personal data - due to its characteristics of full independence and its articulated structures - the body at the protection of human rights.

Furthermore, due to the by now preponderant dimension assumed by digital in the life of citizens, the provision also specifies that the Guarantor must be able to supervise compliance with and application of the human rights also online, well beyond the protection of personal data.

We already have 13 guarantee institutions

Italians are probably the most protected citizens ever, being able to count on well  13 guarantee institutions

1) agency for digital Italy (Agid); 

2) transport regulatory authority (Art); 

3) regulation for network energy and the environment (Arera);

4) competition and market guarantor (Agcm); 

5) for childhood and adolescence (Agia); 

6) National anti-corruption authority (ANAC); 

7) for communications guarantees (Agcom); 

8) guarantee commission for the implementation of the law on strikes in essential public services (Cgs); 

9) national commission for companies and the stock exchange (Consob); 

10) commission for the supervision of pension funds (Covip); 

11) national guarantor of the rights of persons deprived of personal liberty (Gnpl); 

12) authority for the protection of personal data (Gpdp); 

13) insurance supervisory institute (Ivass). 

About the fourteenth

And now the hypothesis of this fourteenth organism, whose birth finds justification in the resolution that the General Assembly of the United Nations approved on 20 December 1993 (n. 48/134) on the establishment of a specific body for the protection and promotion of human rights by the member states.

The creation of an independent human rights institution with guardianship duties it is an international commitment that Italy has undertaken and has repeatedly confirmed in its successful candidacy as a member of the Human Rights Council.

The existing structures and personnel of the Guarantor for the protection of personal data are entrusted with the fulfillment of the new functions of the Guarantor of human rights, integrating the organic role of thirty units with a recruitment carried out through public competition. Operating expenses? The bill states 3 million and 500 thousand euros which will be covered by means of a corresponding reduction in the allocation of the current special fund entered, for the purposes of the three-year budget 2022-2024, under the "Reserve and special funds" program of the "Funds to be distributed" mission of the estimate of the Ministry of Economy and Finance for the year 2023.
