New speed limits on suburban roads and in built-up areas and different rules for Ztl. These are some of the measures established yesterday, Wednesday 7 June, by the Council of Ministers in order to push the closure of eight infringement proceedings and 7 pre-infringement procedures pending over Italy, but also to adapt our legal system to the European one and, finally, to initiate the solution relating to an affair linked to state aid.
All these matters have been included in a decree law, called “infraction saver”, which yesterday received the go-ahead from the centre-right government.
Infringement procedures: "New relationship with the EU"
At the moment they are total 83 infringement procedures that weigh on Italy. Too many, if we take into account that the European average is equal to 66. It is not just a question of numbers, given that every single procedure implies that Italy may receive hefty sanctions and fines from Brussels.
To avoid this, the Government has decided to intervene through the "Salva-infrazioni" law decree which aims at resolve 8 infringement and 7 pre-infringement proceedings.
"The CDM has approved a decree to save infringements, a decree law which specifically provides for a new approach to the relationship with the European Commission", said the Minister for European Affairs, Raffaele Fittoat the press conference. "I think it is a very important work both in terms of the approach to the relationship with the European Commission that the Meloni government wants to have and, on the other hand, I believe it is a very important work in concert with all the ministries concerned", he added , specifying that the aim is to "reduce litigation, thanks to a concerted effort with all the ministries involved".
The decree excludes measures to resolve an even bigger dispute, that relating to bathing. On the matter, the minister spoke of "work in progress" assuring that the same "path" of discussion with the ministries and with the EU will be followed.
New speed limits and first home concessions
Three of the eight infringement procedures that the Government intends to close concern the exceeding of the limits set for the Pm10. As? Through the implementation of the Turin Protocol and the introduction in the Highway Code of new speed limit rules on extra-urban roads and in inhabited centres: it will be up to the Regions to set the limits, having consulted the prefects, while the Municipalities will have to decide what will be the maximum stay time within the Ztl.
Another infringement procedure that the Government intends to resolve dates back to 2014 and regards subsidies on the first home which will also be recognized to residents abroad who have been in our country for at least 5 years.
The other interventions
"The infringement procedures on which action is taken relate to various subjects, from the facilitation of registration tax for the purchase of the so-called first home to protective measures in criminal proceedings and in the procedure for executing the European arrest warrant , from the regulation of voluntary and fixed-term personnel of the National Fire Brigade to the measures for the improvement of air quality and the prevention of risks connected with exposure to ionizing radiation”, explains the Government in a note.
As for the pre-infringement procedures, the closure of cases open to the European Commission is facilitated in relation to the provisions concerning: guarantee of bank deposits (during the extraordinary administration, Bankitalia will have 5 days to assess the unavailability of the accounts reimburse customers); aggregation of insurance periods completed with international organisations; healthcare advertising; issuing of passports; verification of the efficiency of investments in the gas distribution network.
Il state aid case instead it concerns the electrical interruptibility mechanism managed by Terna and part of the national defense system.
