Since last February XNUMX, an important change has been in force for all Italian motorists: road fines will be notified primarily via certified e-mail (PEC), always assuming that the person who receives the fine is in possession of them.

The amendment to Legislative Decree 69/2013, published in the Official Gazette on 16 January, established that fines must be notified electronically to the driver of the vehicle. The e-mail must comply with formal requirements: the subject of the message must be "Administrative act relating to an administrative sanction provided for by the highway code", and a copy of the report with digital signature and other useful information must be attached to the text of the e-mail , such as, for example, the indication of the office from which the document originated.

The potential risk you run is related to the email notification. In fact, the fine will be considered notified when the computer system generates an automatic receipt of acceptance and that of successful delivery of the message to the PEC box of the recipient, regardless of whether the latter has read it.

The new system will cancel the notification costs, which until last month were borne by the fined motorist, and will continue to be so for those who do not have a PEC address. However, those who do not regularly check their PEC address risk forgoing the 30% discount for those who pay within 5 days of notification, or, even worse, having to pay much higher amounts for late payments and accrued interest.
