Motorists who will commit the same offense several times without receiving any immediate dispute will have to pay a single fine. This is foreseen by an amendment approved by the Senate to the decree on the safety of infrastructures and transport which modifies some rules of the Highway Code. The provision should shortly pass to the final examination of the Chamber.

The typical example is that of someone who parks his car without parking and then goes on vacation. On his return, with the current rules, he may find himself under the windshield wiper even a dozen fines, while in the future this will never happen again.

In essence, the new law provides that the administrative offense object of the first notification also end up those ascertained in the previous 90 days and not yet notified. The condition, in addition to the lack of immediate contestation, is that the infringement is always the same.

The costs of assessment and notification relating to each violation will still have to be paid. However, if there are conditions to pay the reduced fine, in these cases the sanction will be equal to three times the statutory minimum foreseen for the infringement committed, if more favourable. Payment can be made within 100 days of the first notification or immediate dispute and will allow for the filing of the absorbed fines to be requested.

Foreign vehicles: the novelty introduced for vehicles registered abroad

A other news introduced by the Senate in the text of the decree then establishes that, in the event of violations committed by vehicles registered abroad, when it is not possible for objective difficulties proceed to enroll in the role or initiate other compulsory collection procedures against the driver or owner, the enforced collection can be activated in the following five years against those who had been found at driving the vehicle. The Ministry of Infrastructure and Sustainable Mobility, in agreement with the Ministry of the Interior, will have to issue a provision to determine the collection procedures.
