The investigating judge of Milan accepted the request for dismissal of the prosecutor: the accusation against the former top management of MPS in the context of a tranche of the investigation into the Alexandria and Santorini derivatives was deemed "groundless".

According to the Court of Milan, the accusation of obstruction of the supervisory bodies of Consob and the Bank of Italy is "groundless" disputed against Alessandro Profumo and Fabrizio Viola, respectively former president and former managing director of Monte dei Paschi. Alessandra Del Corvo, judge for preliminary investigations in Milan, in the decree ordered the dismissal for the two former heads of the Sienese institute as part of a tranche of the investigation into the accounting of financial transactions on Alexandria and Santorini derivatives, which dated to the previous management of Antonio Vigni and Giuseppe Mussari.

The investigating judge in fact accepted the request for dismissal made by the Public Prosecutor's Office. The accusation leveled against the two former top management of Mps was of "having exposed, in order to hinder the functions of Consob and the Bank of Italy, facts that did not correspond to the truth, as well as having concealed with fraudulent means facts which were the subject of a specific request by of the supervisory authorities and concerning the economic, equity and financial situation" of the Sienese bank, with particular reference to the Alexandria and Santorini transactions. The investigating judge considered the accusation "unfounded", accepting the request for dismissal made by the prosecutors of Milan Stefano Civardi, Giordano Baggio and Mauro Clerici.
