Motor liability: it's Ania-Antitrust clash over competition

"The motor liability market in Italy is a competitive market".
This was underlined by Ania, the association representing insurance companies, commenting on the start of the investigation decided by the Competition and Market Guarantor Authority with reference to clauses put in place by eight companies with the alleged aim of preventing the spread of networks in plurimandate.

“Italian insurance companies – observes Ania – comply with the law: the clauses of the agency contracts subject to the preliminary investigation comply with the nature of the fiduciary relationship established between a company and an agent. According to the Civil Code, the latter is the intermediary in charge of developing the business of the principal company. If the provision of clauses is in itself an infringement of competition, agency contracts will disappear and companies will offer their products through other channels".
