I magistrates fight against the introduction of civil liability for their category. Today a delegation from the ANM was received at Palazzo Chigi by Prime Minister Mario Monti. Also present were the Minister of Justice Paola Severino and the Undersecretary of the Presidency of the Council Antonio Catricalà. The Government has undertaken to "study solutions" - assured the Professor - to "reach maximum agreement on a modification" of the law. It is an amendment to the community law presented by the Lega e passed last week in the House against the advice of the Executive. The final vote on the measure now belongs to the Senate.  

“President Monti confirmed the Government's commitment to studying solutions that allow Italian laws to be adapted to European principles – reads the official communiqué from Palazzo Chigi -, also through a comparative examination of the legislations in the various EU countries. On this basis it is the firm intention of the Government to activate a dialogue with the parliamentary forces to reach the maximum agreement on a modification that ensures a correct interpretation of the European jurisprudence and, at the same time, allow magistrates to work with serenity of judgment in the exercise of their functions”.

The president of the National Association of Magistrates, Luke Palamara, welcomed with "satisfaction" for the commitment assured by the Government, but reiterated the firm position of the union: "One thing must be clear, we are not dealing with the judge's call for direct responsibility. Another thing is the responsibility of the state, on which we are in line with the other western democracies”.
