Milleproroghe, the showdown arrives on Autostrade

The Milleproroghe decree should be published on 30 December. News on Atlantia but also on motor liability insurance

The showdown on Atlantia-Autostrade for the Morandi Bridge is approaching and the risk of an interminable legal dispute between the State and the company controlled by the Benettons rises. While waiting to pull the strings of a job that Conte defined as "demanding" and to be completed "rigorously", the government sent the Milleproroghe decree to Colle which, in fact, outlines the stages of the possible farewell to Autostrade and takeover by Anas. But above all, it blocks the possibility of early withdrawal by the fan from the concessionary company. Barring stumbling blocks, the provision will soon be published in the Gazette.

The novelty is that, in the event that the concession to Autostrade is revoked, the new regulations assign the temporary management of the sections to Anas and reduce the penalty that "threatens" the public coffers: according to some estimates, the amount due to Autostrade would go from 23 billion to about 7 billion. A different formulation of the part on concessions, then, in addition to confirming that the new provisions are in fact retroactive and cancel the current agreements and pacts, it deprives the Benetton company of the possibility of taking the initiative and of withdrawing firstthus ensuring higher compensation. The change introduced in the Milleproroghe decree was interpreted as a direct response to the possibility of legal action that Autostrade had clearly indicated in the letter sent to the government a few days ago, including the possibility of resorting to the "legal termination" of the concession. In particular, the key passage is the one inserted at the end of the article of the decree dedicated to Atlantia which states "if the extinction of the concession derives from default by the concessionaire", thus restricting the possibilities of indemnity applicable on the basis of the text of the agreement and it is added "without any legal resolution being able to operate as a result of this provision".

The decision on the revocation of the concessions to Autostrade therefore seems to be numbered. “I was confident of being able to complete the investigation within this month – said Prime Minister Giuseppe Conte in the end of year press conference – there will be a postponement, but we are in the final straight”.

RC FAMILY CAR, SLIDING THE DATE

It is not the only novelty introduced with the final draft of the Milleproroghe. The decree is expected to enter into force on December 30 with its publication in the Official Gazette. If the advances are confirmed, the introduction of the relevant rule will be postponed by 45 days the new RC family car. In practice, the possibility of applying the most favorable class of merit to the entire family will only start from 8 February and no longer from 1 January 2020, always limited to contracts being renewed. There is also the possibility of extending the family car liability to other vehicles (for example, a moped or a van) provided that the property is within the family unit.
