Mediaset part in the attack of Vivendi for the case Premium. Il Biscione has filed a precautionary motion against the French giant with the Court of Milan, asking that it come to him 3,5% of the capital seized held by the group as treasury shares. The news was confirmed by sources close to the Cologno Monzese group.

The hearing to discuss the appeal has been set for the next one 8th November before the judge Vincenzo Perozziello, who will also have to pronounce on the civil case filed by Mediaset and Fininvest against Vivendi to demand compliance with the Premium sale contract signed last April.

The 3,5% of Vivendi, object of Mediaset's precautionary request, is owned one of the assets included in the binding agreement in April, which provided for the exchange of 3,5% of Vivendi with 3,5% of Mediaset and the transfer of Premium to the French group.

The share swap would have taken place precisely through the use of treasury shares held by the two companies. The agreement signed on 8 April was not followed by the completion of the operation which, according to forecasts, should have been closed by the end of September.

Up to now Mediaset has requested, through the civil lawsuit that will be discussed from March, compensation of 50 million euros for each month of delay in the fulfillment of the agreement by Vivendi starting from 25 July 2016.
