Maneuver, fair compensation is strengthened: it will change the fees of professionals

The Chamber approved an amendment to the 2018 Budget law which modifies the new rules on the remuneration of professionals.

Fair compensation is strengthened. The House approved an amendment to the law on Monday 2018 Budget Law amending the new rules on the remuneration of professionals.

First of all, the correction makes the reference to the ministerial parameters for establishing the fairness of compensation more stringent (but nonetheless not binding). It will no longer be enough to "take it into account": the amount of the payments will have to be "compliant" with the criteria established by decree of the Ministry of Justice. Without prejudice to the basic principle according to which the fees must be proportionate to the quantity and quality of the work performed.

Secondly, the proposed modification signed by Forza Italia deputies Nunzia De Girolamo and Sandra Savino eliminates negotiation as an element which in itself excludes harassment. The assumption is that, given the imbalance of bargaining power between the parties, the negotiation would risk being simulated.

In general, fair compensation legislation affects 4 million people. Not only lawyers (as was foreseen in the first version of the decree), but also architects, accountants, surveyors or nurses. All professionals who are members of a professional order, college or association fall within the perimeter of the new rules.

Furthermore, fair compensation applies both when the worker performs a service for a private company and when the client is the public administration.

The corrective measures approved via amendment are in line with the requests of the trade associations after the first go-ahead from the Senate for the manoeuvre.

The work of the Budget Committee in the Chamber should close in the next few hours. The text will thus arrive in the hall at Montecitorio 24 hours after the original schedule. Discounted the use of the vote of confidence. The law should then be approved definitively in the Senate before Christmas Eve.

BABY BONUS

In the end, the baby bonus will only exist for the first year of the child's life and only for those born in 2018. The Budget Committee of the Chamber has eliminated the appropriations envisaged for 2020, canceling the stabilization of the intervention.

The maximum ceiling of 480 euros per year is also gone, but the total budget allocated for 2018 remains (185 million): the allowance for children born in 2018 doubles, compared to the quota set by the Senate, and rises to 960 euros.

DEPENDENT CHILDREN

Then the annual income threshold rises, which allows children to remain dependent on their parents: it goes from 2.840 euros to 4.000 euros.

THE RETOUCHES TO TIME CONTRACTS ARE JUMPING

There was talk of some adjustments to the 2014 Poletti decree on fixed-term work. In particular, the envisaged changes provided for the reduction of the maximum duration of the contracts from 36 to 24 months and the possible extensions from five to three. Eventually, though, these fixes fell through.

WEB TAX

The digital transaction tax goes from 6% set by the Senate to 3%. Furthermore, unlike what was assumed at the beginning, it is not extended to e-commerce. The entry into force remains on January 2019, 190, but, based on updated figures, the estimated revenue rises to 112 million a year. An increase in revenue compared to the XNUMX expected in the version released by the Senate.

SOCIAL BEE

Green light also to the government amendment which extends the audience of the Ape social to four more categories of hard workers (labourers, iron and steel workers, seafarers and fishermen), the same for which, in addition to the other 11 categories already included, will not start from 2019 the increase of the retirement age to 67 years. The amendment also provides for an increase in the contribution discount for working mothers from six months to one year per child, up to a maximum of two years.

BOLKESTEIN DIRECTIVE FOR IMBULANT TRADE

A last-minute amendment to the maneuver postpones the entry into force of the Bolkestein directive on itinerant trade. The correction provides that “in order to ensure that the procedures for assigning trade concessions on public areas are carried out in a homogeneous temporal and regulatory context; the term of the concessions existing on the date of entry into force of this provision and expiring before 31 December is extended until that date". We will therefore talk about it in 2020.
