Majority divided on justice

Despite the negative opinion of the government, the Northern League amendment introducing the civil liability of magistrates has been passed - The ANM threatens a strike - The IDV takes it out on the traitors of the Democratic Party and the Third Pole - Bersani denounces the re-emergence of the old majority Lega-PDL – The Executive is considering a correction in the Senate.

The question of justice once again divides politics and above all the great majority who support the Monti government. What happened? Yesterday in the Chamber, despite the contrary opinion of the Minister of Justice Severino, a Northern League amendment has been passed to the community law (!) which introduces the civil liability of magistrates in the event of willful misconduct and gross negligence. There were 264 votes in favor and 211 against. The Lega and the PDL explicitly voted in favour, but it is evident that thanks to the secret ballot, even the UDC, Fli and Pd parliamentarians voted in favour.

The reactions of the National Association of Magistrates were very harsh which speaks of "revenge and intimidation of judges, of an unconstitutional rule and of legal monstrosity", suggesting that the magistrates could soon announce a strike. Meanwhile Di Pietro for Italy of values, is angry not only with the center-right, but also with the 50 "traitors" who allowed the parliamentary blitz. The reference is to the snipers of the Fli, Udc and Pd. In turn, the leader of the Democratic Party Bersani speaks of a "gesture of total irresponsibility", denouncing "the re-emergence of old majorities", when it comes to justice or Rai. Indeed, in recent days, the Rai board of directors has indicated the directors of Tg1 and regional Tg, on the basis of a very small majority of the directors appointed by the Pdl and Lega. The group leader of Berlusconi's party Fabrizio Cicchitto denies that he speaks of "free voting in the classroom", referring to a convergence which, as Di Pietro also observed, goes beyond the League and the PDL.

At this point the Government has hoped for a correction of the amendment by the Senate and also the leader of the third pole Pierferdinando Casini thinks that the law, at this point, needs to be reviewed. The fact remains that justice is a raw nerve in politics, which risks, even on future occasions, jeopardizing the majority that supports the government. In the next few days the Mills trial could reach its conclusion (albeit only in the first instance and then be time-barred) and many members of the PDL have already announced that a possible conviction of Silvio Berlusconi will not remain without political consequences.

In short, despite the now sharply declining spread, and the start of discussions with the unions and Confindustria on labor costs, difficulties for the Executive could derive from the internal front of politics: the question of justice, not to mention the very recent scandals, linked to electoral refunds to parties, which, as the Radicals have been denouncing for some time, and the Lusi case has brought to the fore, constitute a real public funding in contradiction with the outcome of a referendum passed with a large majority. It is no coincidence that yesterday Bersani and Casini proposed immediately putting their hands on a law on parties, which according to the leader of the third pole could be approved in a very short time.
