The Constitutional Court justified the sentence of 4 December 2013 on the electoral law, paving the way for a solution invoked by Renzi, namely the Spanish model with fixed preferences and lists.

The Constitutional Court filed the reasons for the sentence of 4 December 2013 on the electoral law, known as "Porcellum".

The judges also provided a general framework for the drafting of a new law, defining “dthe majority bonus envisaged by the Porcellum is distortive" because it "heralds an excessive over-representation", not requiring "the achievement of a minimum threshold of votes for the list".

Furthermore, the Consulta has opened up the short blocked lists envisaged by the Spanish model. But without rejecting the other two models fielded by Renzi: correct Mattarellum and double shift on the model of the mayors.

Also because "there is no model of electoral law imposed by the Constitutional Court". In practice, fixed preferences and lists are admitted: this is the identikit of the Spanish system which is being talked about in recent weeks as the new Italian electoral law.
