The Competition Authority launches an investigation into unsolicited electricity and gas contracts entered into by Enel after complaints made by consumers

The Antitrust shines a light on Enel for unsolicited contracts

Electricity and gas contracts stipulated without the knowledge of consumers: this is the 'accusatory' hypothesis against the Enel group on which the Antitrust is working. The news was given by the Authority itself with a notice published in the weekly Bulletin aimed at informing interested parties, who had already made a report, to intervene in the proceeding. 

A symptom that the Authority must have received several reports because the notice, based on the regulation on unfair commercial practices, is needed precisely when there are too many interested parties to be reached by single notifications.

The proceeding, initiated also on the basis of complaints from Federconsumatori, Codacons and Tutela Noi Consumatori, will have to verify whether consumers have had unsolicited supplies of electricity and gas activated without ever being contacted by Enel and Enel Energia agents. 

Under the Antitrust lens also misleading information (or lack of information) given by agents or call center operators on the reasons for the visit or phone call, on the characteristics and economic conditions of the proposed offer with the aim of carrying out activations of unsolicited supplies of electricity and/or gas. The last behavior object of the preliminary investigation is the obstacles to exercising the right of reconsideration.
