The compromise reached on article 18 provides for the return of the right to reinstatement for unjustified dismissals of a disciplinary nature.

Jobs Act, no trust: agreement in the Democratic Party on article 18

The government will not place its trust in the House on the Jobs Act, because the factions within the Democratic Party have reached a compromise on the intervention that rewrites article 18: the right to reinstatement will return for unjustified dismissals of a disciplinary nature, while only the possibility of compensation for those unjustified of an economic nature.

The deputy secretary of the Pd Lorenzo Guerini is satisfied: those who wanted to “open fronts in the Pd had a good response. The party within its expression in the Labor commission has been able to carry out serious work, a comparison of merit by going to a shared point that responsibly commits everyone ".

The innovations that will be introduced in the Commission take up the agenda approved on 29 September last (130 votes in favour, 20 against and 11 abstentions). On the point relating to article 18, the agreement reached in the leadership of the democratic party established, with the exception of the possibility of reinstatement in the workplace also for disciplinary dismissals, as well as for discriminatory ones, "a discipline for economic dismissals which replaces the uncertainty and discretion of a judicial proceeding with the clarity of certain financial compensation that increases with seniority, abolishing the possibility of reinstatement".

Another point foresees the reduction of contractual forms: "Starting from the unicum Italian co.co.pro., favoring the centrality of the open-ended employment contract with increasing protections, in safeguarding true collaboration relationships dictated by the needs of workers or by the nature of their professional activity". Finally, a reform of the employment services is envisaged, the organization of which should favor the integration "between public, private and third sector operators within clear and incentive rules for all".
