Jobs Act and article 18: the agreement in the Pd gives rise to Ncd

Reconciliation within the Democratic Party risks costing the Government a new split, this time with the New Center-Right. The matter of contention is once again the amendment to article 18 to be included in the Jobs Act being studied by the Chamber.

Today the Government will present an amendment to implement the agreement reached within the Pd on the reintroduction of the reinstatement option for dismissals without just cause for disciplinary reasons. A move that has unleashed the wrath of Ncd, because the new text does not correspond to what was agreed. The rift risks putting the numbers of the majority in the Senate into question.

The Undersecretary for Labour, Teresa Bellanova, spoke of "reformulation" without news but explained that the provision of reinstatement in the workplace in the event of disciplinary dismissals "for a reason declared by a void or non-existent judge" will be included in the delegation.

The Ncd group leader, Maurizio Sacconi, replied that the amendment “does not correspond to what was agreed. If we saw a different text than the one we know, we would leave the Commission and a big dispute would start in the majority".

For Ncd, in the event of dismissals judged to be illegitimate, the rule should be financial compensation with the maintenance of reinstatement only in discriminatory dismissals (already governed by the Civil Code) and in very limited cases of disciplinary dismissals.

Bellanova's rejoinder was not long in coming: “There is no forcing, we are serious people, I don't play the game of three cards. We must stay calm and serene. Reintegration will be provided for unjustified disciplinary dismissals, but we will write the cases in the delegated decrees ".
