La Constitutional Court will communicate its decision on theitalicum. The sentence was expected for 13-13.30, but the judges are still meeting in the Council Chamber. Yesterday, after a morning hearing for the arguments of the lawyers who contested the law and an hour in the afternoon for the State Attorney's Office, which asked instead to confirm the legitimacy of the Italicum, the Consulta adjourned to today, Wednesday 25 January.

In particular, the constitutional judges must evaluate the legitimacy of the ballot, of the majority premium, of blocked list leaders, of multiple candidatures with the candidate's option to choose in which constituency to be elected. The findings on these aspects are contained in five orders received from the courts of Messina, Turin, Perugia, Genoa and Trieste.

At risk especially the ballot: some judges would like to save him, but almost certainly won't make it. According to the appellants, the principle of representativeness is trampled underfoot in the name of governability and the disproportion is excessive because there is no minimum quorum of votes to be reached to access the ballot, it is enough to finish second in the first round.

“Since whoever finishes second risks winning the votes of those who finished third in order to defeat the first – underlines the lawyer Vincenzo Paolillo -, a relative majority does not turn into an absolute majority, but a minority into a majority”. However, the State Attorney's office counters that this system is in force in countries close to us that have applied democracy well before us.

In the Court there are also those who would like to abolish the majority premium too high, but it seems unlikely that this point will be cleared. He could skip the possibility instead of lead list blocked elected in more constituencies to choose the place of election thus determining, at their discretion, who to let into the other constituencies as second elected.
