Imu, Tares and land registry reform: the proposals of the Senate

The Senate Finance Committee has unanimously approved the final document of the investigation conducted on the taxation of the property. There are six guidelines in the document: federalism, land registry reform, Imu, dry coupon, Tares and the real estate market.

Imu, Tares and land registry reform: the proposals of the Senate

Eliminate the first Imu 2013 installment on first homes, approve the fiscal delegation by October to start the land registry reform and postpone the entry into force of the Tares until 2014. These are the three necessary interventions identified by the Senate Finance Committee in the final document of the investigation conducted on the taxation of real estate.
 
The guidelines of the document can be summarized in six points: federalism, land registry reform, Imu, dry coupon, Tares and the real estate market.

Federalism
Taxation relating to real estate must be the exclusive responsibility of local authorities.

Cadastre reform
In the context of the final document, the Commission underlines the urgency of a reform and the need for the approval of the tax delegation bill by October, the entry into force of the reform delegated decrees starting from 2014 January 2014 and a transitional since XNUMX. This should involve the transition to the criterion of square meters and the abolition of the cadastral categories completely superseded by the real characteristics of the real estate assets. Finally, the Commission proposes the adoption of an automatic mechanism for the periodic review of cadastral income.
 
IMU
In relation to the Imu, the document calls for an intervention aimed at eliminating the deadline for the payment of the first installment of 2013, as well as a reform that is based on the principles of fairness, sustainability of the tax and reasonableness. In particular, the Commission points out asymmetries to be eliminated by specifying how the primary homes of residents abroad must be exempt and how new regulations are needed for properties given on loan for use to first-degree relatives and for the homes of those who have moved their residence to nursing homes.

Dry coupon
The document proposes both to increase the deduction from the taxable base for substitute tax purposes, restoring the percentage of deductibility to 15%, and to identify incentive mechanisms to combat evasion.

Tares
As well as the taxation relating to real estate, the municipal tax on waste and services must also be the exclusive responsibility of the Municipalities. Furthermore, the document states the need to postpone the entry into force of this tax to 2014.

Real estate market
The Commission proposes to adopt measures on the sales side, reducing the charges for the contractors in terms of ancillary costs (notaries, technical certifications, etc.) and taxes on transfers.

Finally, the document praises the consolidation of tax breaks for building renovations and energy savings which, as mentioned in the document, "goes in the right direction". The investigation is now being examined by Fabrizio Saccomanni, who will have to present a reform proposal by the end of the month. The Commission unanimously approved the document developed by Raffaella Bellot (Lega), Franco Carraro (Pdl), Federico Fornaro (Pd) and Andrea Olivero (Sc) and handed it over to the Deputy Minister of Economy, Luigi Casero.
