Companies, Pec mandatory from 1 October. Fines tripled

By Thursday 1 October, companies will have to communicate their Pec to the Registry - Anyone who does not do so will be subject to official assignment and a fine of up to 2 thousand euros

Mandatory Pec from 1 October for companies. Starting Thursday, businesses that do not have a digital domicile will be subject to fines exceeding 2 euros. The novelty was established under the Simplifications decree.

PEC FOR COMPANIES: THE NEW RULES

According to data provided by Sole 24 Ore, there are around 1,7 million companies currently registered in the Register that do not have a valid Pec. The new law provides that companies that do not have an active certified e-mail address univocally attributable to the company or which, despite having one, have not yet communicated it to the Business Register, will have to do so by 1 October.

MANDATORY PEC: FINES FOR THOSE WHO BREACH THE RULES

“Owning a certified e-mail address, which facilitates relations with the Public Administration, was already an obligation since 2008 for companies and since 2012 for sole proprietorships. But if the failure to communicate so far only provided for a temporary suspension for sending electronic files to the Business Register, now it can lead to a fine of between 206 and 2.064 euros for companies, between 30 and 1.548 euros for sole proprietorships " .

The amount of the fine has been doubled or tripled compared to what was previously established. Expected only one exception, valid for companies at the first registration. In this case, companies that do not indicate a Pec will face the suspension of the application. In the event that the holders fail to forward the request by entering the Pec, the sanction will be triggered.

For companies that do not comply with the new legislation by 1 October, in addition to the fine, "the Chamber of Commerce will officially assign a digital domicile by the Chamber of Commerce", further specifies Unioncamere

MANDATORY PEC: HOW TO MAKE THE COMMUNICATION

The association reminds that the communication is not subject to stamp duty or secretarial fees. To do so, the owner or legal representative of the company must access the site ipec-registroimprese.infocamere.it and follow the instructions on the platform. Access can be done via Spid or Cns/wireless token. Alternatively, it is possible to forward the communication through the Chamber of Commerce website of your territory.
