With an amendment to the Pnrr-simplifications governance decree, the principle according to which the certifications issued by the Regions were valid only at a regional level is overcome

Agricultural entrepreneur (Iap): the qualification is now valid throughout Italy

The qualification of Professional Agricultural Entrepreneur (Iap) will soon be valid throughout Italy. This is foreseen by an amendment by the 5 Star Movement to governance decree Pnrr-simplifications, which received the go-ahead in committee and the parliamentary process begins on Wednesday in the Chamber. This is a fundamental provision for obtaining the funds of the Next Generation Eu program (the "Recovery Fund"), starting with the advance of 13% of the total funds (about 25 billion for Italy) which is due by July to the 12 countries whose Pnrr has already been approved by Brussels.

The promoter of the new law on Iaps is Filippo Gallinella, a Grillino deputy and president of the Agriculture commission in Montecitorio. "The verification of possession of the requirements relating to the qualification of Professional Agricultural Entrepreneur (IAP), carried out by the individual Regions, exercises full effect throughout the national territory - explains Gallinella - An amendment of the 5 Star Movement to the Simplifications and Governance decree of the National Recovery and Resilience Plan (PNRR) was in fact approved in the joint Environment and Constitutional Affairs commissions ".

The amendment makes it possible to overcome "the principle that was gaining ground in case law - continues the deputy grillino - on the basis of which the certifications issued by the Regions for the recognition of the qualification of Iap exercise their effects only at the regional level, with consequent disregard of this subjective status of farmers operating in other regions. Guidelines that undermined a principle of unity of the regulatory system causing, in fact, a fragmentation of the civil orderwhich, however, falls within the exclusive competence of the state".

At the basis of the qualification of Professional Agricultural Entrepreneur, in fact, "there are principles of a general nature that must receive uniform and homogeneous application - underlines Gallinella - Therefore, with our amendment we ensure that the regional assessment of the qualification, referred to in the decree no. 99 of 2004, is valid throughout the national territory, definitively resolving an unfortunate and paradoxical situation”.
