"Should the preventive seizure continue - reads the text -, even in the face of the changed authorization framework and the underlying assessments, carried out by the strictly competent Authorities, the obvious economic-financial unsustainability of the new operating conditions - and of the purpose of excellence and of uniqueness in the European context, which animates them – would inevitably lead to the definitive cessation of the production activity and the closure of the production pole". 

In the application, the lawyer and the president of Ilva clearly write that "the new authorization framework (the revision of the Hague by the Ministry for the Environment which provides for new and more incisive prescriptions for the steel industry, ed.) postulates interventions and investments , even in the short term, for values ​​that involve recourse to credit, which is impossible in the presence of constant measures limiting the ownership and management of the establishment".

In short, "either the real precautionary constraint placed on the hot area of ​​the Ilva plant in Taranto ceases, or compliance with the incisive plan of adaptation interventions and compliance with the new emission limits becomes - immediately - economically unsustainable".
