Justice, Conciliation Week: mediation in the Chambers of Commerce in a month and a half

Almost 79 thousand mediation proceedings filed with the Bodies of the Chambers of Commerce since the start of the mandatory nature of the conciliation attempt (March 2011); 45 days the average duration for the resolution of these disputes; 124mila euro the value of the proceedings. These are the numbers of civil and commercial mediation carried out by the Conciliation Desks of the Chambers of Commerce which, in the first 9 months of 2015, saw the total of proceedings grow by another 10% for over 15 mediations.

The 102 structures registered in the Register held by the Ministry of Justice, which in June 2014 represented only 11% of the accredited Bodies, received 21% of the total disputes filed in one year, allowing 27% of those who had decided to participate in the mediation meeting, to resolve the dispute.

These are some elements of the activity in the field of alternative justice carried out by the chamber system, engaged since yesterday in the XII Week of Conciliation, the traditional appointment promoted by Unioncamere and created by the Chambers of Commerce to disseminate information on the news and advantages of mediation with specific initiatives carried out in many territories.

The mediations of the Chambers of Commerce

In the 4 and a half years of "mandatory" mediation, recourse to alternative justice has reached the maximum quota in the regions of the North-East, where 32% of requests for mediation have been filed at the chamber offices. Followed by the North-West and the South, both with 24%, then the Center (20%).

The sector with the highest number of proceedings filed at the chambers of commerce between September 2014 and September 2015 is that of banking contracts, an area to which 20,6% of the total disputes belong. The "productivity rate" of the Chambers is high: from April 2011 to September 2014, the conciliation desks disposed of 92% of the proceedings filed.

The rate of participation in the procedure is still not very high. In the period October 2013-September 2015, when the procedure was finalized, there was a non-appearance of the member 6 times out of 10, while, when the member participates in the meeting, the agreement reaches a positive outcome in 27% of cases.
