Alternative justice: 95 mediations at chamber offices

Bank contracts, real rights, lease, condominium. In one out of two cases, Italians "fight" over something that has to do with these areas. Between June 2015 and June 2016, 50,9% of the civil and commercial mediations filed at the 102 counters of the Chambers of Commerce concentrated on these sectors. And the 22 requests for mediation filed in one year have increased the balance of proceedings presented since March 2011, when the mandatory attempt at conciliation was introduced, to more than 95.

These are some of the data that emerged during the XIII Week of Conciliation, the traditional appointment promoted by Unioncamere and created by the Chambers of Commerce to disseminate information on the news and advantages of mediation with specific initiatives carried out in many territories.

Piemonte, Venice-Rovigo, Milan and Vicenza are the chamber structures to which citizens and businesses most frequently turned in the year under consideration for this form of alternative justice also administered by the chamber system. In the 5 and a half years it was mandatory, recourse to mediation reached the maximum quota in the regions in the North-East, where 32% of the applications were filed at the chamber offices. Followed by the North-West, with 24%, the South (23%) and then the Center (21%).

The "productivity rate" of the Chambers is high: from April 2011 to June 2016, the conciliation desks disposed of 92% of the finalized proceedings.

Still not very high the membership rate to the proceedings. In the period June 2015-June 2016, the non-appearance of the member was recorded at the first meeting in 55% of cases, while, when the member participates in the meeting, the agreement reaches a positive outcome in 40% of cases. And it's a real shame, considering the advantage in terms of time (in 48 working days it was possible to resolve disputes with an average value of 135 thousand euros) and costs ensured by mediation in relation to ordinary justice.

If, in fact, according to World Bank data, the cost of a lawsuit before the Court compared to the amount of the same is estimated at 29,9% for Italy, in the case of mediation it is around 3,9% , with the consequence that the average saving for single cause is equal to 26 percentage points.
