France: Sarkozy released, but the hypotheses of crime are very heavy

Former President of the French Republic Nicolas Sarkozy he was released in the middle of the night, after 15 hours of detention, after being notified of the opening of an investigation into very serious crimes, but at the moment without any measures restricting his freedom. The hypotheses of crime against him are: active corruption of a judge, complicity in violating the secrecy of the investigation and "trafficking of influences".

This offense is typical of French law, where it was already introduced at the end of the 2012th century, but is extraneous to the Italian tradition. It was only included in our penal code in 346, in article XNUMX bis, following Italy's accession to international conventions of the UN and the Council of Europe. The "trafficking of influences" consists in illicit mediation aimed at carrying out acts contrary to the official duty of a public official.

In the middle of the night, the judges notified him of the opening of the investigation, the same fate befell his trusted lawyer a few minutes before him, Thierry Herzog, and to the magistrate of Cassation, Gilbert Azibert.
