Il Tar of Lazio raised the question of legitimacy constitutional on the measure 'spread incentives' relating to photovoltaics, accepting the flood of appeals received in recent months against this law. Now the provision, contained in the law decree 91/2014 ('Competitivity' law decree), will have to be submitted before the Constitutional Court.

The measure 'spread incentives' had aroused protests, among others from Assorinnovabili and Confagricoltura, since it contains a remodulation of the incentive tariffs for photovoltaic with a heavy retroactive cut.

“We are confident – ​​commented Agostino Re Rebaudengo, President of assoRinnovabili, and Mario Guidi, President of Confagricoltura – that the Court will confirm the orientation of the TAR and will declare the constitutional illegitimacy of the spread of photovoltaic incentives. We hope that the Government can immediately retrace its steps and cancel the law with the forthcoming Green Act, thus also restoring Italy's image and attractiveness to investors. The cancellation of the rule - they recall - would also resolve the international arbitration procedure that has begun with foreign investors".
