Fininvest seeks 570 million in damages from Vivendi for Premium

A war on all fronts, though the rumors of "opening" by Mediaset. Fininvest asks Vivendi to respect the agreements relating to the contract signed with Mediaset last April, but that's not all. The holding company of the Berlusconi family has requested damages of 570 million euros from the French giant led by Vincent Bolleré.

This is what can be read in a note issued by the company in via Paleocapa, in which the group announces that it has filed a writ of summons with the Court of Milan in order to obtain that Vivendi "be ordered to fully comply with the attached shareholders' agreement to the contract signed with Mediaset on "April 8" and relating to Premium. 

In fact, as a result of the agreement, Fininvest and Vivendi would have signed a shareholders' agreement at the closing on the participation of the French in Mediaset.

In today's deed, Fininvest “asks in any case compensation for the serious damages already suffered. These damages amount to a figure of no less than 570 million euros, related, among other things, to the decrease in value of the Mediaset shares as a result of the incident, the non-appreciation of the same if the execution of the contract had been carried out, as well as the 'evident damage to image'.

An expected act that adds to the lawsuit filed by Mediaset which requested "the compulsory execution of the contract by order of the judge and compensation for the damages suffered up to now by Mediaset, currently estimated at an amount equal to 50 million euros for each month of delay in fulfillment by Vivendi to as of July 25, 2016”. The total damage deriving from any failure to comply with the contrary is also added to the figure. Considering the request for compensation announced by Fininvest today, the overall claim for damages for the failure to conclude the sale of Premium risks well exceeding 2 billion.

It should be emphasized that on Piazza Affari the Alfa stock closed the session up 4,3% at 2,8 euros following the opening arrived yesterday from a Mediaset spokesperson regarding a reorganization agreed for Premium, but only after the binding contract signed in the spring has been executed.
