The reasons for the July 16 sentence which had deemed legitimate the agreements entered into between Fiat and the unions (including Fim and Uilm) were filed today. The agreement was opposed by Fiom which claimed to have been deprived of authority. The labor judge of Turin, Vincenzo Ciocchetti, referring to the principle of effectiveness, declares that it would not be possible to invalidate contracts, stipulated in derogation from the national contract, by effectively representative unions and, moreover, confirmed in a referendum by the vast majority of workers.

Therefore, the request of the CGIL cannot be accepted, despite the recognition of a disorganization in the stipulated contract. The document, however, reiterates that Fiom cannot be excluded from trade union representation. The employer, explains Ciocchetti, must maintain a position of neutrality towards the unions. Fiom's exclusion from representation was judged anti-union.
