Electronic invoice, Di Maio: "Stop fines until everything is clear"

“We are trying to mitigate the effects” of electronic invoice and for this reason "there will be no sanctions until it is clear what to do”. This was stated by the Deputy Prime Minister and Minister of Economic Development, Luigi Di Maio, according to reports from some participants in the meeting with the 33 entrepreneurial acronyms underway at the Mise. The appointment was attended, among others, by representatives of Confindustria, Confesercenti, Cna, Confcommercio, Confartigianato, Casartigiani.

Di Maio opened the meeting by undertaking to set up a permanent table, with the aim of discussing possible corrections to the maneuver and to the simplification decree. “Back to concertation”, added the minister, again according to what those present reported.

In addition to the issue of electronic invoices, Di Maio also touched on other crucial topics for businesses. The deputy prime minister would have confirmed, for example, that the Inail relief will arrive and that the problem of the credits owed by companies towards the public administration. As for theIMU, the minister guaranteed that it relief on warehouses will go up to 50%.

Returning to electronic invoice, the theme of sanctions for those who go wrong (or simply make mistakes) is one of the most controversial in recent months. What is certain is that, at least initially, the tax authorities will be lenient with those who violate the electronic invoice obligation between private individuals. In fact, the tax decree linked to the maneuver provides that the penalties will be canceled for those who issue the document within the period's liquidation, while they will be reduced to 20% for those who comply with the law within the subsequent liquidation.

The expiry of this sanction regime was initially set at 30 June 2019. Later, also to meet the demands of accountants, some amendments presented by the majority and by the opposition had proposed to extend the moratorium to the whole of next year. In the end, a compromise was reached: mini-sanctions until 30 September 2019, a solution that was to become a reality through a reformulation of the amendments already tabled.

However, Di Maio's latest statements seem to reopen this chapter, giving to entrepreneurs and to all the VAT numbers involved from the novelty of the electronic invoice, the hope of reduced (if not completely eliminated) penalties for a longer period of time. A request made by the categories concerned and for which Marina Calderone, president of the Labor Consultants, spoke: "Among the novelties - she said - there must be the non-application of sanctions at least for 2019 to kick off a long run-in period"
