With the publication of the relaunch decree in the Official Journal, the definitive rules on the 110% eco-bonus arrive: who can request it, on which jobs does it apply? First and second homes? Here are all the answers

110% Ecobonus: subsidized jobs and definitive rules

The 110% eco-bonus is reality. After the rumors of the last few weeks, with the publication of the relaunch decree in the Official Gazette, the definitive rules on the maxi facilitation valid for those who decide to carry out works that increase the energy efficiency of buildings and reduce the seismic risk (the so-called sismabonus) arrive.

The relaunch decree contains the details relating to the works that will entitle you to the 110% eco-bonus, the conditions for using them and the audience of potential beneficiaries. So let's see what are the definitive rules envisaged by the Government to give impetus to the construction sector grappling with the crisis caused by the coronavirus pandemic.

110% ECOBONUS: THE LIST OF "Driving" JOBS

The relaunch decree identifies three types of work, so-called "drivers", which give the right to access the 110% eco-bonus, providing for different spending limits for each of these interventions. To access the subsidy it will be necessary to carry out these works from 1 July to 31 December 2021. 

According to article 119, the following are subject to the maxi discount of 110%:

  1. thermal insulation work on opaque surfaces of buildings that affect at least 25% of the gross dispersing surface. In this case, the expenditure ceiling was set at 60 euros for each real estate unit in the building;
  2. works on the common parts of the buildings that require the replacement of existing winter air conditioning systems with centralized condensing systems, heat pumps (including hybrid or geothermal systems, also combined with the installation of photovoltaic systems and related storage systems), or microgeneration. The spending limit is 30 euros per building unit.
  3. The third driving intervention concerns single-family houses. The 110% eco-bonus applies to the replacement of winter air conditioning systems with microgeneration or heat pump systems for heating, cooling or domestic hot water supply. Also in this case the expenditure limit is 30 thousand euros.

For work to replace air conditioning systems, both in condominiums and single-family homes, the 110% eco-bonus also applies to costs relating to the disposal and reclamation of the replaced system. 

110% ECOBONUS: OTHER WORKS

The relaunch decree provides that the 110% eco-bonus also applies to other types of interventions currently subject to the 50 or 65% deduction. But there is one condition: these interventions must be carried out together with at least one of the "driving works" indicated above. 

Taking a practical example, if we replace the air conditioning systems or carry out insulation work on the building, we are entitled to the 110% eco-bonus even on the replacement of windows, on the installation of solar panels, etc. 

The decree also specifies that the 110% eco-bonus also applies to expenses incurred for the installation of photovoltaic systems within a spending limit of 48 euros andinstallation of electric columns for car charging. Also for these two interventions, the condition is that they are carried out in parallel with one or two of the driving works listed above. 

110% ECOBONUS: CONDITIONS

There are three other access conditions:

  1. the 110% eco-bonus is applied to the expenses incurred from 1st July to 31st December 2021;
  2. interventions must guarantee the improvement of at least two energy classes of the building. If this is not possible, the highest energy class must still be achieved. All this must be demonstrated through an energy performance certificate (Ape) issued by an authorized technician. 
  3. Through a Ministerial Decree which will be issued in the next 30 days, all the details relating to the rules and limits to be respected in order to access the superbonus will be clarified. For now, therefore, we have to wait a little longer. And it should in any case be considered that the decree - in the process of being converted into law in Parliament - may undergo changes.

110% ECOBONUS: WHO CAN REQUEST IT

In paragraph 9 of article 119 of the relaunch decree, the audience of beneficiaries is specified. The following will have access to the 110% eco-bonus:

  • condominiums; 
  • natural persons, outside the exercise of business, arts and professions, on real estate units
  • the Autonomous Social Housing Institutes (IACP) and entities with the same social purposes, 
  • housing cooperatives with undivided ownership, for interventions carried out on properties owned by them and assigned for enjoyment to their members".

SECOND HOMES YES OR NO?

The 110% eco-bonus is valid on first and second homes in condominiums and on single-family homes used as main residences. On the other hand, it cannot be applied to interventions carried out on single-family houses that serve as a second home. 

SISMA BONUS AT 110%

The relaunch decree provides that you have the right to a 110% deduction also for seismic improvement works on buildings, provided that these are located in seismic zones 1, 2 and 3 (therefore excluding 4). The suberbonus is valid for both condominium work and for single-family houses and is also valid for the purchase of anti-seismic buildings. 

DEDUCTION, ASSIGNMENT OR DISCOUNT IN THE INVOICE

Both the ecobonus and the 110% sismabonus can be used directly by taking advantage of a 110% deduction of the expense incurred (recovery in 5 annual instalments). Alternatively the credit can be transferred to companies executors (but you need to be sure that the chosen company provides for this option) to banks, other financial intermediaries or, only for the sismabonus, to an insurance company. Third alternative: opt for one 100% invoice discount the cost of the works by the company. The latter will acquire a credit of 110% and will in turn be able to transfer it to banks, third parties or financial intermediaries.
