That's why Ischia is a real amnesty

Lisa Noja, lawyer and Pd deputy, explained on Facebook why article 25 of the Genoa Decree will allow illegal houses to be built in dangerous areas. Just as the tragedy of Caasteldaccia in Sicily alarmingly re-proposes the danger posed to the community by illegal building, the intervention is an appeal to the Senate to modify the law already ratified by the Chamber.

Lisa Noja, lawyer and Pd deputy, published this analysis on her Facebook profile. We report it here in its entirety as it clearly demonstrates that the one reserved for the houses of Ischia is, to all intents and purposes, an amnesty even if the government would like to disguise it.

“These are the facts. Anyone can verify them. Then, everyone is free to form their own opinion.

– The art. 25 of the Genoa Decree is entitled “Definizione deamnesty procedures".
– The art. 25 establishes that the Municipalities of Casamicciola Terme, Forio and Lacco Ameno on the Island of Ischia "define the requests for amnesty relating to buildings destroyed or damaged by the earthquake of 21 August 2017", pending at the date of entry into force of the decree and presented in based on three past amnesties (law 47/1985, n. 47, law 724/1994, DL 269/2003, later converted).
– The art. 25 establishes, however, that for the definition of such requests "the provisions of Chapters IV and V of the law of 28 February 1985, n. 47". Therefore, the conditions set out in the 1994 Law must also apply for the amnesty practices presented pursuant to the laws of 2003 and 1985.
– Under the 1985 law it is possible to repair buildings that the two amnesties subsequently approved by the Berlusconi governments in 1994 and 2003 prohibit, i.e. the 1985 law allows for the regularization of buildings built in dangerous areas from a hydrogeological and seismic point of view, bound by landscape, or in state-owned or protected areas.
– According to current legislation, therefore, a building damaged in 2017 which was awaiting a decision on an amnesty application filed under the regime of the 1994 or 2003 law and which was located in a restricted location or in seismic risk areas, volcanic or hydrogeological of the island of Ischia would remain abusive and should be demolished.
– Thanks to the art. 25 of the Genoa Decree approved by the Pentaleghist majority in the Chamber of Deputies, this building may, however, be forgiven and rebuilt with public funds for reconstruction. That is, with taxpayers' money.
