Telecom Italia will set itself up civil party in the trial on the illegal dossiers which will begin on February 18th. Marco Tronchetti Provera was indicted for receiving stolen goods in the context of one of the lines of investigation into the alleged illegal dossiers prepared by the security of the TLC group, an event that took place at the time of the battle for control of Telecom Brazil between the Italian telecommunications company, then chaired by Tronchetti, and some Italian investment funds. The crime expires in September 2014. It is a direct summons from the deputy prosecutor of Milan Alfredo Robledo, the preliminary hearing is skipped. Tronchetti, president of Pirelli, ended up on trial for having received, in order to "make a profit", some data stolen from the computer of the investigative giant Kroll with a hacking operation carried out in 2004 by some men from Telecom's IT security, while staying at a hotel in Rio de Janeiro, Brazil. According to the investigations, it would have been Giuliano Tavaroli, Telecom's head of security at the time, who made Tronchetti aware of the contents of the files, "illegally intercepted and then stolen from the Kroll", who allegedly sent the files anonymously to Tronchetti's secretariat and then turn them over to security to legitimize their use. All this, again according to the reconstruction of the investigators, on the basis of a specific agreement with the manager. Even Asati, the association of Telecom's small shareholders, "will appear as a civil party" in the criminal trial.

THE DEFENSE OF TRONCHETTI
"We are certain that we will be able to demonstrate in the trial that no illegal behavior has been put in place," said Marco Tronchetti Provera's lawyer, Roberto Ramponi. “It is important to immediately remember that the material received at the Pirelli headquarters, the object of the disputed crime and proving the espionage carried out by the Kroll agency against Telecom Italia, was immediately sent to the Brazilian judicial authorities and, subsequently, to the Italian one. Moreover, it is clear that this behavior was certainly not to the detriment of Telecom Italia, but aimed at protecting the company” specifies the lawyer who recalls: “Kroll had already brought actions against Telecom Italia before the indirect entry of Pirelli in the shareholding structure and, subsequently, also against Dr. Tronchetti and his family. For this reason, the CEO of the March & Mclennan company, which had acquired the Kroll agency, felt obliged to officially apologize to Dr. Tronchetti Provera”. "We also acknowledge that Telecom Italia would have filed a civil action in the proceeding relating to receiving stolen goods, but we believe that it is not entitled to do so since, as mentioned, the company is not a person offended by the crime, nor a damaged party".
