Teachers and law enforcement agencies: vaccination obligation from 15 December

From Wednesday 15 December, for teachers and school staff on the one hand and for law enforcement, security, defense and public aid forces on the other, snap and the vaccination obligation provided for by the anti-Covid decree launched by the Government, the same provision that gave the green light to the super green pass. On 14 December, the Ministry of the Interior and that of Education issued circulars containing the rules to be respected. Anyone who fails to comply is subject to very high fines.

THE VACCINAL OBLIGATION FOR LAW FORCE

The vaccination obligation in force since 15 December concerns not only the primary vaccination cycle, but also "the administration of the subsequent booster dose to be carried out in compliance with the indications and deadlines set by the circular from the Ministry of Health". Simply put, anyone who has received the first two doses of the vaccine for over five months must also have the third dose or booster. 

The obligation applies to all personnel, including those absent from service. The workers will have to "produce the documentation certifying the fulfillment to the manager of their own structure". 

SANCTIONS AND FINES

If the competent administration does not receive the documentation certifying the vaccination, it will have to invite the male or female worker "without delay" to deliver all the requested material within 5 days. In the event of non-compliance, the forces of order will trigger not only the suspension of service without any compensation, but also the temporary withdrawal of the "identification card, plate, supplied weapon and handcuffs".

Anyone who works without a vaccine is punishable by a fine of between 600 and 1.500 euros, while those who do not check are subject to a fine of between 400 and 1.000 euros. 

THE VACCINAL REQUIREMENT FOR TEACHERS AND ATA

Similar rules also for workers in non-equal schools, early childhood education services, provincial centers for adult education, regional vocational education and training systems and regional systems that implement technical education and training courses superior. 

School staff will therefore also have to demonstrate that they have carried out the vaccination or have booked the vaccine in the following 20 days after the obligation comes into force. As required by the police, anyone who has completed the primary vaccination course for more than five months must produce the documentation certifying the administration of the third dose. 

The checks must be carried out by the headteacher or his delegate who will have "a new tool" at their disposal to carry out the necessary checks. “In particular, a new function has been introduced within the Education Information System (SIDI) which schools can access which, alongside the platform already activated in September for green pass control, allows school principals to verify – through an interaction between the Education Information System and the National Digital Green Certificate Platform – the vaccination status of permanent and fixed-term teaching and ATA staff in service at each individual school institution”, explains the Ministry of Education. An alert system is also envisaged which will make it possible to automatically know changes in the vaccination status of the staff.
