Copyright and its future: effects of the Barnier directive

The subject was studied during a conference held at the LUISS University, the conference “The effects of the Barnier Directive (2014/26/EU) on the Italian and Pan-European market for the management of copyright and related rights. Italy/UK: systems compared”.

Copyright and its future: effects of the Barnier directive

Today Italy, the only case in Europe, reserves the management of copyright to a "single subject", the Barnier Community Directive, currently under discussion in the Senate, should change the scenario with a real revolution for Italian artists and for a market worth millions and millions of euros.

The conference, organized by the lawyer Maria Francesca Quattrone, founder of the DIKE law firm, specialized in copyright and intellectual and industrial property, saw the participation, among others, of Giovanni Pitruzzella, President of the Guarantor Authority for Competition and the Market, Davide D'Atri, Soundreef CEO, Gaetano Blandini, SIAE General Manager and Luca Scordino, SIAE Management Board Member, Paolo Marzano, President of the Permanent Advisory Committee for Copyright, Laurence Pawley, Head of Department Intellectual Copyright Office UK, Mario Libertini, Professor of Commercial Law and Gustavo Olivieri, Professor of Competition and Innovation Law at the Luiss School of Law. During the round table, among others, Federico Morando (Creative Commons), Carlotta Ca Zorzi (La7, Head of Legal Affairs), Stefano Selli (Mediaset, Head of Institutional Affairs), Gianluigi Chiodaroli (Itsright), Andrea Miccichè (Nuovo Imaie ), Alessandra De Marco (Presidency of the Council of Ministers), Claudio Buja (Universal Music Publishing Italy).

Of fundamental importance in particular, according to the lawyer Maria Francesca Quattrone, founder of the DIKE law firm: "Transparency towards artists on their rights managed by the collecting societies, to be implemented with information campaigns on what it means to be the owner of a copyright or also connected in economic terms and on the methods of collecting fees and rules for greater transparency and accessibility of the data held by collecting companies and users. These two aspects will allow greater awareness and a decrease in the number of often unidentified or identifiable rights holders who at the moment will generate funds, not distributed to artists, in the collecting coffers".

To the question: The implementation of the Barnier directive is upon us, are we really at day zero?
