Gay rights: European Court condemns Italy to recognize unions

La European Court in Strasbourg orders Italy to introduce legal recognition for same-sex couples. The European Court of Human Rights has condemned our country for the violation of the rights of three Italian same-sex couples who appealed to the judges of Strasbourg after being refused by the municipalities of Trento, Milan and Lissone the possibility of making publications in order to get married. For the Court it was violated Article 8 of the Convention of human rights, the one on the "right to respect for family and private life". The judges also ruled that the Italian State will have to pay each of the applicants 5 euros.
Now all 47 ECHR states are in theory forced to legalize same-sex marriage. "The Court - reads the note - considered that the legal protection currently available in Italy for same-sex couples not only fails to provide for the key needs of a couple engaged in a stable relationship, but it is also not sufficiently reliable".

And yesterday an important news arrived for all those who intend to change sex, at least in the registry office. The first section of the Court of Cassation accepted the appeal presented by the lawyers of the Lenford-Advocacy Network for LGBT rights, who assist a 45-year-old trans person who has been known socially for years as a woman but who has no intention of undergoing surgery.

The Court of Piacenza and the Court of Appeal of Bologna had rejected the request for rectification of the civil status even in the absence of the surgery since, according to the jurisprudence on the merits, the modification of the registry documents had to be linked to the effective and concrete execution of surgical treatment on the genital organs. With today's decision, the Cassation wanted to remove the constraint of surgery as the only opportunity for a person's sex change in terms of age.
