Dell'Utri: the Florence court orders a maxi seizure of 10,8 million euros

Over 10,8 million euros seized from Marcello Dell'Utri and his wife Miranda Ratti. The measure was ordered by the investigating judge of the Florence court, at the request of the anti-mafia district prosecutor's office. 

The reasons for the kidnapping

According to the accusation, the former Forza Italia senator would have violated the Rognoni-Latorre law, the same one that established the crime of mafia association and which, for those convicted of mafia crimes, establishes the obligation to communicate all changes in income exceeding 10.330 euros. Dell'Utri, on the contrary, would not have communicated changes amounting to over 42 and a half million. Hence the decision to proceed with preventive seizure.

The final sentence against Dell'Utri dates back to May 2014, when the Supreme Court confirmed a 7-year sentence against him for external complicity in a mafia association. From that moment on, Silvio Berlusconi's former right-hand man would have had to communicate to the competent authorities any type of change in assets, while according to the accusations he would have failed to communicate movements worth many millions of euros, a large part of which is linked to sums paid over the years by Berlusconi. The provision also affected the ex-wife's assets because this would have effectively been at Dell'Utri's disposal, despite the two having divorced in 2020. 

The note from the Florence prosecutor's office

Through a note, the Florence prosecutor's office explained that the real precautionary measure, it is explained, "is part of the framework of criminal proceedings which are the subject of a wider investigative coordination, carried out, at a national level, by the National Anti-Mafia Directorate, aimed at identifying the external principals of the continental massacres of 1993-1994“. Procedure during which "various investigations were conducted regarding the financial flows involving Marcello Dell 'Utri from 2014 to today". 

“In particular, the real precautionary measure – continues the note – was requested and obtained” because, “the suspect, with multiple actions and omissions, at different times, in execution of the same criminal plan, despite being required to "fail to" communicate, within the terms established by law, the changes in assets indicated in the art. 30 of the same legislation for a total amount of 42.679.200 euros".

“With the provision, direct preventive seizure was ordered, up to the sum of 10.840.451,72 euros, attributable to Marcello Dell'Utri as well as, for the portion of 8.250.000,00 euros of the overall sum indicated above , even indirectly attributable to the aforementioned, through Miranda Anna Ratti“, Dell'Utri's wife, “or for equivalent on the assets in the direct and indirect availability of Marcello Dell'Utri in the methods and quotas indicated above”, concludes the Prosecutor's Office.
