News on the Inclusion allowance, fixed-term contracts, job administration, smart working and a "bonus" for the worker in the tourism sector come from the second tranche of amendments approved in the work decree. The Senate Social Affairs Committee is preparing to vote on Tuesday, June 13, 2023 on the coverage of the amendments. Some of the key points of the work decree are still to be defined but here are the main new features arriving.

Employment decree, news for the inclusion allowance

Change theInclusion check, the measure introduced by the Meloni government instead of the much discussed one Basic income. The novelty, contained in an amendment to the Labor decree, concerns i constraints for the beneficiaries and the stalls for the occupants. the beneficiary of the inclusion allowance with children under 14 is required to accept an open-ended offer, even on administration, only if within 80 km or reachable in 2 hours by public transport. Instead, the employable beneficiary is required to accept an open-ended job offer with no distance limits, for the nucleus with children under the age of 14, "even if the parents are legally separated", the offer must be accepted if the job "does not exceed" 80 kilometers from home or "can be reached within 120 minutes" by public transport.

Finally, the Inclusion Check also comes abstract also to people being treated by the social and health services (in addition to members of families with disabilities, minors or those aged at least sixty), and it is envisaged that the card cannot be used for expenses such as gambling, cigarettes (electronic and otherwise) or alcohol.

News on the renewals of fixed-term contracts in the decree

Also renewals, and not just the extensions, of a fixed-term contract will be without cause up to 12 months. The contract can be extended and renewed freely in the first 12 months and, subsequently, only in the presence of the reasons in article 19, paragraph 1. The change is not retroactive: for the purposes of calculating the 12 months, in fact, only contracts stipulated after the entry into force of the decree are taken into account.

Job administration

News also for the administration, with theabolition of quantitative limits (20%) currently envisaged for apprenticeship personnel and also those for the hiring of mobile, unemployed or disadvantaged workers.

As regards the first point, the quantitative limit of 20% does not apply to temporary workers hired under an apprenticeship contract.

In any case, the temporary outsourcing of mobile workers referred to in article 8, paragraph 2, of the law of 23 July 1991, n. 223, of unemployed persons who have enjoyed non-agricultural unemployment benefits or social safety nets for at least 6 months and of disadvantaged or very disadvantaged workers.

“Special bonus” for tourism workers

Throughout the summer season (from 1 June 2023 to 21 September 2023), workers in the tourism sector, including thermal establishments, will be provided with a sum as supplementary treatment special, which "does not contribute to the formation of income, equal to 15% of gross wages paid in relation to night work and overtime work performed on holidays".

The measure, if confirmed, will affect private sector workers who in 2022 declared an income of up to 40 euros.

Extension of smart working

After a long back and forth, the extension on smart workingbut only for the private sector. The right to perform work in agile mode has been extended until 31 December 2023 exclusively for fragile workers and for parents of children under 14.

Carers, zero contributions for those who hire

An amendment to the labor law approved in committee in the Senate provides for a total de-contribution for 3 years for those who hire or stabilize caregivers who assist non self-sufficient elderly people.

The amendment concerns 2023, 2024, 2025 and provides for "a 100% contribution exemption, up to a maximum amount of 3.000 euros per year, for 36 months, in the case of permanent employment and transformations of domestic work contracts with assistant duties to non self-sufficient person over 65 years of age". However, the benefit does not apply if a domestic work relationship between the worker and the employer has ceased for less than 24 months.

No news in the work decree for fringe benefits

No good news for i fringe benefits. The tax-free threshold remains fixed at 3 euros only for employees with children. During the work on the decree in the Social Affairs Commission of the Senate, the hypothesis of modifying the law emerged, while the orientation is now to intervene with an ad hoc measure starting from the proposal to bring the threshold to 1.000 euros for everyone plus a bonus of 660 euros per child.
