Cyberbullying, House approves the law

Montecitorio unanimously voted for the new law that protects or punishes minors who are victims or perpetrators of bullying on the web: now the minor under 14 (or his parent), if attacked on the web, will be able to report the facts to the website manager or social media.

The Chamber of Deputies approved unanimously with 432 votes in favour the bill 'Provisions for the protection of minors for the prevention and fight against the phenomenon of cyberbullying'.

The provision identifies the purpose of the intervention in contrasting cyberbullying in all its manifestations through a strategy that includes preventive and educational measures for minors (victims and perpetrators of bullying on the web) to be implemented in schools.

What does the new law provide?

In particular, the law provides that the minor who has turned 14 and is the victim of cyber bullying (as well as each parent or whoever exercises responsibility for the minor) may apply to the manager of the website or social media or, in any case, to the data controller to obtain inhibitory and prescriptive measures for his protection (obscuration, removal, blocking of any other personal data of the minor disseminated on the Internet, with conservation of the original data). The data controller or the manager of the website or social media must communicate, within 24 hours of the request, that they have taken on the task and must act on the request within the following 48 hours. Otherwise, the interested party can make a similar request, by means of a report or complaint, to the Guarantor for the protection of personal data who must do so, according to current legislation, within the following 48 hours.

“Let me say hello to Dr. Picchio, Carolina's father, who took his own life at the age of 14 and was the first recognized victim of cyberbullying. We must dedicate this provision to her and to the other victims, which is a first step but it was absolutely necessary". She said it the president of the Chamber Laura Boldrini speaking in the classroom before the vote on the bill.
