Corruption: up to 5 years in prison

The new article 318 provides for the increase in prison terms for crimes of corruption, from a minimum of one to a maximum of five years. In its current guise, the penalty ranges from a minimum of six months to a maximum of three years.

Important progress on the anti-corruption bill.

After an effective consultation with the political forces, the Minister of Justice Severino filed the amendment to the bill this afternoon, which will now be able to enter the live phase of parliamentary discussion.

The articulation of the text provides, in cases of corruption for the exercise of the function, imprisonment from one to five years: ""The public official who, in relation to the exercise of his functions or powers receives for himself or for a third party money or other benefit or accepts the promise is punished with imprisonment from one to five years”.

The new article 318, in the reformulation adopted, allows "to reconstruct with greater precision the boundaries between the various forms of corruption: on the one hand, the proper corruption which remains anchored to the perspective of the satisfaction of an act contrary to official duties, from other the acceptance or the promise of undue utility by the public official or the person in charge of a public service, regardless of the adoption or omission of acts inherent to one's office".

In its current guise, Article 318 provides for between six months and three years of imprisonment for crimes of corruption.
