Light and gas contracts: two-year statute of limitations for the right to pay the amount

Protection of consumers in the matter of balancing billing for the supply of electricity, gas and water services: the topic was brought to the attention of the Production Activities Commission of the Chamber, which concluded the examination in the referring office of the bill which now move on to the scrutiny of the classroom. In particular, in the supply contracts relating to these services, a statute of limitations is introduced equal to two years for the right to payment of the consideration.

The bill also includes rules relating to: the user's right to suspend payment pending verification of the legitimacy of the operator's conduct; the reimbursement of payments made by way of undue adjustment and the definition, by the competent regulatory authority - the Authority for electricity, gas and the water system (AEEGSI), of measures to protect consumers, of measures aimed at encouraging self-reading, as well as rules for end customers' access to data regarding their consumption.

The application of the standard refers to invoices issued to domestic users and micro-enterprises. With regard to the scope of application of the provisions introduced by the bill, it is limited to invoices whose expiry: is after the date of entry into force of the law for the electricity sector; for the gas sector it is after 1 January 2019; for the water sector it is after 1 January 2020.
