Confindustria against the abandonment of Fiat: "An unacceptable choice"

The presidency committee of viale dell'Astronomia responds to the abandonment of the Lingotto with a note in which it underlines that "there are strong guarantees regarding the effectiveness and enforceability of the agreements to ensure the necessary margins of flexibility for the company organisation", therefore the reasons of the Turin industry "cannot be shared".

Confindustria "does not agree" with Fiat's decision, which this morning formalized the will of leave the industrial association. “Thanks to the action of Confindustria – reads a note from the presidency of viale dell'Astronomia – very large spaces are now recognized for company bargaining. There are strong guarantees regarding the effectiveness and enforceability of the agreements to ensure the necessary margins of flexibility for the corporate organisation. Companies therefore have greater certainties regarding their operations".

The presidency committee therefore stresses that Confindustria takes note of "Fiat's decisions, even if it does not agree with the reasons, also from a technical-juridical point of view". In the same letter from the managing director of Fiat, Sergio Marchionne, "it is recognized that the regulatory framework on the subject of industrial relations, which, moreover, had already been strongly innovated with the 2009 agreement - the entrepreneurs underline again - has significantly improved due to the of the inter-confederal agreement of 28 June and of article 8 of the maneuver of August”.

Confindustria then underlines that it has “never questioned the validity and applicability of article 8” and, on the contrary, that it has “always reaffirmed its consistency with the agreement of 28 June. According to the majority of labor law experts, in no way has the ratification of the interconfederal agreement which took place on 21 September weakened its effects or placed additional limits on the applicability of the law”.

The presidency committee adds that "the agreement of 28 June was approved unanimously by the Confindustria council both in July and in September and received the applause of the European authorities and the main international institutions". Therefore, "Fiat's decision appears all the more unacceptable to us since, as is well known, the Confindustria statute allows you to remain associated with the system without granting trade union delegation, as is already the case for numerous associated companies that do not apply agreements signed by trade associations category of Confindustria. We hope that the collaboration with Fiat can continue in the local organizations in compliance with the association rules".
