Growing cannabis at home is no longer a crime, so long as the quantity is minimal and the destination is personal use. They decided it with a historic sentence the united criminal sections of the Court of Cassation, putting an end to a long series of conflicting decisions from various Italian courts.

The fundamental legal principle is the non-punishment of those who grow marijuana in small quantities, indoors and outdoors not in the greenhouse, but with typical home gardening tools.

The pronunciation of the Cassation is also revolutionary because it scores a change of course compared to what was established by the Cassation itself in 2008. At the time, in fact, the joint sections had established that growing cannabis is always a crime, even if in small quantities and for exclusively personal use, as it still paved the way for the circulation of drugs. Now that's not the case anymore.

She has also expressed herself on the same subject on various occasions the Constitutional Court, emphasizing the danger from a health point of view that users may encounter and therefore adopting a more rigorous line.

Now it is established that the cultivation of drugs in itself is always punishable, but small-sized crops carried out at home must be considered excluded.

The Supreme Court had been called to rule on a specific case. That of a 29-year-old boy sentenced by the Naples Court of Appeal for possession of two marijuana plants.
