Catalonia: Puigdemont asks for immunity to avoid arrest

The Constitutional Court has established that the appointment of the new president can only take place with the presence of the same in the parliamentary hall, but if Puigdemont returns to Spain he risks arrest – Immunity would allow him to participate in the investiture session to be held in Parliament and be re-elected president of Catalonia.

Carles Puigdemont plays the last card. The ousted president of Catalonia, who is expected to be reappointed governor of the Generalitat tomorrow, has sent a letter to the newly elected president of the Catalan Parliament, Roger Torrent, asking to receiveand parliamentary immunity and thus be able to participate in the session of the investiture assembly to be held tomorrow, January 30, without risking being arrested.

The Iberian newspaper writes it El Pais, according to which, Puigdemont would have asked to "enjoy immunity, with the effect of not being able to be arrested except in the case of a flagrant crime" and to have his right guaranteed to attend tomorrow's session during which he should be re-elected head of the Catalan government.

The Constitutional Court has in fact established that the appointment of the new president can only take place with the presence of the same in the parliamentary hall, excluding the possibility of “electronic investiture or by proxy to another parliamentarian” feared until a few days ago. Simply put, Puigdemont, self-exiled in Belgium, will have to appear in person in Parliament, otherwise he will not be able to be confirmed at the helm of Catalonia. Without immunity though, returning to Spain would mean risking immediate arrest for rebellion, sedition, embezzlement.

Furthermore, as early as this morning, the police set up checkpoints on the Ap7 motorway on the border with France to prevent the pro-independence leader from "returning home" by escaping the radar of justice.
The Spanish interior minister, Juan Ignacio Zoido, has warned that he will not be able to return "not even hidden in the trunk".

Meanwhile, the constitutional judges have not yet given their opinion on the appeal lodged by the Spanish Government which aims to cancel Puigdemont's candidacy for the regional presidency. However, the investiture session, which will open on 30 January at 15.00, is less than 24 hours away. Time is running out and the former president
