Companies can lay off their employees not only due to economic difficulties or in the event of corporate restructuring, but also with the simple aim of increasing profits. This was established by the labor section of the Court of Cassation, annulling a sentence of the Court of Appeal of Florence which had compensated a worker fired in 2013.

In particular, the sentence of the Supreme Court states that firing for "a more convenient organization of work for an increase in profit" is legitimate.

The Cassation also wrote that "the objective reason for dismissal determined by reasons inherent to the productive activity, which also includes the hypothesis of organizational reorganization for the management of the company, is left to the evaluation of the employer, without the judge can review the choice of company management criteria”.

In other words, the entrepreneur can "establish the employment dimension of the company, evidently in order to pursue profit which is the lawful purpose for which he undertakes the action".
