Broadband Infratel: the Tar bowl Tim

The company contested the methods of the first tender launched by Infratel, arguing that they would have favored Open Fiber (Enel) - At this point it is likely that Tim will contest the Tar's decision before the Council of State

Il Tar of Lazio dismissed the appeal of Telecom Italy against the first call for tenders launched by infratel for the creation of the ultra-broadband network in areas where there is no market. According to Tim the race arrangements would have favored Open Fiber, a company of the Enel group.

The Tar's decision "confirms the correctness of the tender - reads a note from Infratel, controlled by Invitalia - a tender developed after a rigorous investigation and in-depth technical work".

The opposition remains open Fastweb, the Swisscom group, which however now seems to be heading for a similar outcome to Tim's, according to a source familiar with the matter. The Tim and Fastweb appeals were presented last year, after the publication of the tender procedures.

At this point Tim is likely to dispute in front of the Council of State the decision of the Tar. Furthermore, new appeals to the Administrative Court cannot be ruled out, considering that in the meantime the tender has been won by Open Fiber. The Enel company was thus awarded the lots of the first 1,4 billion euro tender for Lombardy, Veneto, Emilia Romagna, Tuscany, Abruzzo and Molise.

CEO Enel, Francesco Starace, anticipated in recent days that Open Fiber is likely to win also for the next 1,2 billion tender for the regions of Piedmont, Valle D'Aosta, Liguria, Friuli Venezia Giulia, Umbria, Marche, Lazio, Campania, Basilicata, Sicily and the autonomous province of Trento.
