The Antitrust has initiated 9 proceedings against as many Serie A clubs for unfair terms in the contracts for the purchase of season tickets and match tickets.

The Competition and Market Authority has launched nine proceedings – which does not mean that he has issued a sentence, but that there are sufficient conditions to investigate – in the matter of unfair terms against companies Serie A football including Atalanta, Cagliari, Genoa, Milan, Lazio, Juventus, Rome and Udinese. Roma lose about 2,3% on the stock exchange, Lazio and Juventus stable (11:25 am).

The companies Bologna and Parma also ended up in the crosshairs, but the Authority closed the proceedings after having found that they had changed their general terms and conditions, with the removal of clauses accused of being vexatious.   
These are those clauses that would not recognize consumer rights: 

  • to get the reimbursement part of the season ticket or single access pass in the event of closure of the stadium or part of it; 
  • to get the reimbursement of the access ticket for the single race in the event of postponement of the event, both for facts attributable to the company, and when this circumstance is independent of the latter's responsibility; 
  • to achieve the compensation for damage if such events are directly attributable to the company. 

These clauses could be vexatious pursuant to the articles 33, 34 and 35 of the Consumer Code since, by excluding or limiting the liability of football clubs, they would seem likely to introduce a consumer imbalance in contractual services.
